non performance of a hired atty.

A relative died Oct. 2010. A son of hers asked me to be appointed trustee. I hared an atty and paid him 1200.00. He was given a letter requesting the court to appoint me and I was told by him they would copy the letter on his letterhead and send it out. This was in March 2011. After not hearing from him for five months, (he told me it would take a while) I called for an update. I was told by his assistant I needed to give them another check for 40-400 dollars for a filing fee for the state and she now had the letter typed and after I signed it she would now file the letter. After being told by the atty. the letter would be sent in after I hired him, I was shocked to find nothing had been done by them to date. I would like to know if I have any recourse to recover my money as they have done nothing to earn it.
