Executor and Trustee sign a contract not to invade principal of trust for any reason. Executor uses money from the estate to pay funeral expenses, etc. Three years later, Executor takes $9,000 from trust principal to repay herself for funeral expenses stating that she has a right to do this because there was only a joint account to draw from (never proven). Did she have the right to break the contract and take this money? Needs to Know NYS law
