Legally if someone is subpoenad no matter what state they are in, if they dont show up a bench warrant is put out on them and they go to jail. My advice to your friend is #1 if the person will not be a good witness for him or her then dont let them get subpeonad. #2 if your friend thinks the person will be on thier side good, but if any doubt by all means dont do the subpeonad. A example, I had a M4 in Ohio, they subpeonad my friend from Georgia to Ohio and I didnt think they would ever do me wrong but, because he was so mad about having to go to court, I ended up with 22 months in prison for menacing which is usually just probation. So advise my advice is, if you think the person to be subpeonad will make your case worse then make a plea bargain. I just dont want anyone else to spend 22 months in prison if they dont have to. I thought I wasnt going to make it. Good luck
