I'm not a lawyer, just checking on my own entry! But I'd have to say that if it was, it's (still or simply) not enough to for them to charge - as in take up time/resources with a trifle. OTOH, some of these cops are akin to SS wanabees. In your case, it sounds more like their problem.
Technically, I do recall that it doesn't take much for a charge like this. These guys should (and do for the most part) be taking each encounter exclusively simply due to complexities.
