My ex husband is wants custody of our child and in his defense he has all lies there is nothing that is true. He says i dont feed her and that I am trying to keep him away form her even thought she spent the whole summer vacation with him. And now i got a letter saying that he wants a defult judgement because I did not show up in court. I was not aware of the court date. I also dont have a lawyer because I am a student and I dont have money to pay up front for a lawyer. I was going to talk to the judge and explain it to him myself. But I want to know if just be cause i was not informed of the court date and i missed it does this give him legally defult judgement?

The judge will determine custody based on the best interests of the child. Although it may hurt your case that you were not there, it does not automatically mean he will get full custody. What you need to do is reply to your ex husbands motion objecting to a default judgement based on the the fact that you were never notified. I recommend contacting your local BAR association to see if they can refer you to a free legal clinic in your area.
