Labor and employment law encompasses a wide variety of rights relating to activities that arise out of the relationship between employers and employees. The basic premise of labor and employment law is the protection of employees against arbitrary, inappropriate and unfair actions by their employers.
Common lawsuits brought under labor and employment laws are employment discrimination, safety in the workplace, workers compensation, wrongful termination, anti-union actions and other situations that occur in the place of employment.
In order to successfully win a discrimination lawsuit, the plaintiff must fall within a protected class since employees are not legally permitted to discriminate on the basis of gender, age, race, religion, nationality, or physical disability. Some jurisdictions have additional protected classes as well.
Workplace safety arises out of the employers duty to maintain a safe work environment and proper training. Failure to do so can result in actionable injuries.
Workers compensation suits are brought when an employee is injured on the job. Although employees generally can be fired without cause and they can choose to leave their employment at-will, under certain circumstances employees can bring lawsuits for wrongful termination.
Some common reasons for wrongful termination are discrimination or retaliation for disclosing illegal company activity.
Labor law differs from employment law because it focuses on unionization and other union activities such as collective bargaining.
