furniture abandoment

I am moving into my fiance's apartment at the end of this month February 2011 because my lease is up and we are getting married this coming May. His lease isn't up until September but his ex - girlfriend's name is still on the lease and they broke up two years ago. She refuses to get her name off the lease and to get her furniture out of the apartment. We have told her repeatedly to make arrangements to get her things out, she is aware that I am moving in, but still refuses to get her things out. My question is, are we withing our legal rights to have the Goodwilll come and get her things because she no longer lives here and is just trying to be controlling? Please reply asap as this is a time sensitive issue. Thank you in advance for your assistance, Sincerely Julia Soon to Be Garcia

If his ex-girlfriends name is still on the lease, she is still entitled to use those premises. I would not throw any of her stuff out because then she may be able to obtain damages. I would recommend consulting an attorney regarding this matter but seeing as how her name is on the lease, I don't think you can take any action without court approval first.
