A owner has been sued along with the business (S-Corp). There are 2 other owners and according to a email from the opposing atty he just decided to pick him. First, being a S corp is this legal, 2nd we have spent 8,000.00 to date to take care of this matter. Our atty wanted us to file bankruptcy which we did not want to do. We wanted to work with the union to pay the back benefits. THere is a agreement in place and we have been keeping up our side of the bargain but now the opposing atty wants to make it legal and that will cost us more money. Our atty wanted 1500.00 more to represent us in the case but from the beginning the main objective of this was to get the one owners name off of the lawsuit. He didnt do that.....just lots of emails and phone calls between the 2 attys. Not much accomplished. I think he mad at us for not filing bankruptcy. We went against what he said because we wanted to stay in business and work it out. Now comes a court hearing and we have no lawyer....its just to formalize the paperwork. Do we have to appear at that hearing?
